CONSENT TO CONTACT AND SERVICES – TERMS AND CONDITIONS

At Dr J Negus, we are committed to delivering professional, respectful, and high-quality service. 1. Responsibilities

Dr J Negus and affiliated staff agree to:

Communicate clearly, respectfully, and in a timely manner
Maintain your privacy and confidentiality
Offer information about treatment and services in a way you can understand
Consult you on matters regarding your inquiry or treatment
Deliver services in accordance with Australian law and relevant professional standards
Keep accurate records of consultations and correspondence

Your Responsibilities
You agree to:

Provide accurate and truthful information necessary for your inquiry or service
Treat staff and practitioners with courtesy and respect
Inform us of any concerns regarding communication, appointments, or service delivery
Pay any applicable fees in a timely manner
Follow all policies outlined in these Terms & Conditions

2. Payment of Fees

Where applicable, service fees are payable at the time of consultation or within the agreed timeframe. Failure to pay may result in additional action, including collection of outstanding debt, the application of interest charges, or legal recovery of funds.

Accepted payment methods may include:

EFTPOS on site
Bank transfer (with prior approval; confirmation to be sent to admin@drjnegus.com)
Direct debit for ongoing services or programs, as arranged

3. Cancellation Policy

Appointments should be cancelled with a minimum of 24 hours' notice.

Late cancellation (less than 24 hours): 50% of the consultation fee will be charged
No-show: Full consultation fee applies
Cancellation must be made via email at admin@drjnegus.com or by phone

4. Default in Payment

If payment is not received by the due date:

Interest of 2% per annum above the provider’s standard bank overdraft rate may be applied
Collection and legal costs will be passed on to the client
Services may be suspended until payment is received in full

5. Consent, Risk, and Outcomes

By contacting us or participating in services, you acknowledge:

That your care or consultation may involve certain risks
That outcomes may vary and no specific result is guaranteed
That you are responsible for disclosing relevant health information
That any programs or exercise advice given must be followed at your own discretion

6. Feedback & Disputes

If you have feedback or concerns:

First contact our administrative team or Practice Manager
If unresolved, you may escalate your concern to the Principal Provider or Director
We take all complaints seriously and aim to resolve issues respectfully and promptly

7. Liability & Waiver

You agree to release and hold harmless Dr J Negus and any affiliates from any liability for:

Injury or illness occurring in connection with services, unless caused by proven gross negligence
Property loss or damage while on premises
Errors, delays, or miscommunications from third-party systems or providers
Circumstances beyond our control including, but not limited to, illness, transport disruptions, or force majeure events

Participation in any physical program, assessment, or consultation is undertaken at your own risk.

8. COVID-19 Risk Acknowledgement

You acknowledge the inherent risk of exposure to COVID-19 when attending appointments. While we implement best-practice safety protocols, we cannot guarantee complete protection. By visiting our clinic, you voluntarily assume the risk of exposure and agree not to hold Dr J Negus or staff liable for any resulting illness or consequences.

9. Media Release (CCTV, Photography & Video)

During services or group sessions, we may occasionally take photos or videos for professional use or marketing. If you do not consent, please notify us in writing. No images will be used without your express or implied consent.

10. Ending the Agreement

Either party may terminate service arrangements with 10 business days’ written notice. Serious breaches of these terms may result in immediate termination without notice.

11. Privacy Policy (Summary)

We are committed to protecting your personal information. Our privacy practices align with Australian law and include:

Collecting only necessary information for providing services
Holding data securely, whether in paper, electronic, photo, or audio format
Not disclosing information to third parties without your consent unless required by law
Providing access to your information upon written request
